WALKER -- The Cass County Board took the unusual action Tuesday to require a private landowner to remove a fence from a city lot in Hackensack.
The board voted to require Mel Rateike to remove a split rail fence from the perimeter of his residential lot within two weeks. If Rateike does not comply, the board asked the county highway department to remove it.
The city of Hackensack issued Rateike a permit for the fence in July. The lot is on the corner of First Street and Whipple Avenue (County State Aid Highway 204).
County Engineer David Enblom inspected the installation at the request of Hackensack city officials and determined the fence appeared to be 10 feet inside the street right-of-way rather than on Rateike's property.
