FARGO, N.D. (AP) - The man convicted in the 2003 kidnapping and killing of University of North Dakota student Dru Sjodin of Pequot Lakes has been granted more time in his death sentence appeal.
The 8th U.S. Circuit Court of Appeals upheld the death sentence of Alfonso Rodriguez Jr., last month, in a 2-1 ruling.
His lawyers plan to ask the entire 8th Circuit to reconsider the appeal. At least six of the 11 judges in the 8th Circuit would have to agree to another hearing.
Under the standard deadline for seeking such a hearing, Rodriguez's attorneys would have had to file a petition by Tuesday. The extension gives them until Nov. 23.
