Former Brainerd man indicted for child pornography

A 32-year-old Illinois man and former Brainerd resident has been indicted on charges of child pornography.

Daniel Allen Janowiak, of Delavan, Ill., was charged with one count of possession of child pornography and one count of receipt of child pornography.

Janowiak's indictment, filed Wednesday in U.S. District Court in Minneapolis, alleges that on May 29, 2008, while residing in Minnesota, Janowiak knowingly possessed one or more images of minors engaged in sexually explicit conduct. It also alleges that on May 15, 2008, Janowiak knowingly received similar visual depictions that were transported via a computer. Janowiak later moved to Illinois.

This case is the result of an investigation by the FBI and the Brainerd Police Department. It is being prosecuted by Assistant U.S. Attorney Erika R. Mozangue.

Brainerd Police Chief John Bolduc said his officers assisted FBI agents in executing a search warrant at Janowiak's south Brainerd residence. He referred all other questions about the case to the FBI.

If convicted, Janowiak faces a potential maximum penalty of 20 years in prison on the receipt count and 10 years on the possession count. All sentences are determined by a federal district court judge.

In 1998 Janowiak was charged in Crow Wing County District Court with a charge of gross misdemeanor fifth-degree criminal sexual conduct. He was convicted of the charge and sentenced to six months jail and two years supervised release.

This case is part of Project Safe Childhood, a national initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse.
