A. Approve council minutes of Sept. 1 and budget work session of Sept. 3.

1. Approve the Advanced Engineering Proposal for the Future Water Tower Property Evaluation in the not to exceed amount of $12,220 contingent on Item No. 5.D. be removed from the Standard Terms and Conditions of the Proposal.

2. Approve the WSN Proposal for Engineering Services for the Five Year Bituminous Overlay Plan and 20-year Streets Maintenance Plan Update in the not to exceed amount of $3,800 and add replacement of signal lights to the 20-year Streets Maintenance Plan.

D. Accept ARC Minutes of Sept. 3

E. Accept Planning and Zoning Commission minutes of Sept. 8

F. Approve JMS Park Fee Agreement

G. Adopt Resolution No. 09-9/2-1 A Resolution approving and authorizing execution of a Development Agreement with Grand Oaks Court for Tax Increment Assistance.

H. Adopt Resolution No. 09-9/2-2 Setting the Preliminary 2010 Property Tax Levy at $5,730,500.

I. Adopt Resolution No. 09-9/2-3 Approving the Preliminary 2010 Budget

J. Set the public hearing to review the 2010 Budget and Levy with public testimony for Nov. 30 at 6:15 p.m. and amend the 2010 Budget Calendar to Reflect the Revised Start Time

1. Adopt Ordinance No. 2009-15 Zoning Text Amendment which would amend Section 10-3-8 E 4 "Encroachment Exceptions" of the Baxter zoning code which would consider increasing the allowed size of a stoop allowed to encroach into a non-shore land front yard from 50 to 64 square feet per staff's findings.
