Menard, Home Depot at odds over use of advertisements

MINNEAPOLIS (AP) -- Home-improvement retailers Menard Inc. and Home Depot Inc. may be headed to court over an advertising dispute.

Menard alleges in a lawsuit filed in U.S. District Court that Home Depot stores in Apple Valley and Elk River made copies of Menard's New Year's advertising, removed the Menard name in some cases and posted the ads for a competing sale.

The lawsuit was filed Wednesday. Menard operates the stores popularly known as Menards.

Menard, based in Eau Claire, Wis., wants Home Depot to stop using its ads and return profits the Atlanta-based chain earned from any misuse of its trademarks.

Home Depot did not immediately return a phone call Thursday.
