Hay bales and snowmobilers
I’m calling in response to the person by Merrifield who put straw bales up to keep the snowmobilers away. Do people not realize how much business and tourism snowmobilers bring into this area? We need that money in the economy right now. Second of all, does the person not realize that the area in the ditch is not their property. It is property of the highway. It is not their property. If a snowmobiler got hurt on that, that would be a terrible lawsuit and would that person like to lose everything they have just to keep a couple snowmobilers out?
Will they work it out?
I’m wondering if the Brainerd City Council is going to work out the funding issue before they go through with their projects in 2012 or if they’re going to credit card it like they did in 2011? In my finances, I pay for everything as I go and I believe this town will be better off if our council would reach the same conclusion.
Handicapped stickers
I’d like to know how it can be that these young kids are able to get around using handicapped stickers? I’ve seen so many of them pulled into a handicap spot and they run into the store and run out. If they are using their parents’ stickers, that is against the law. It should be turned in and it will be turned in by me if I see it. But I think something needs to be done about this.
Fix the sound system
It must be quite obvious to anyone who watched and listened to the Brainerd City Council meeting Monday night that the sound system needs work. Fading in and out of the sound and especially the garbled words was very noticeable and irritating. Is there a technician? Who’s responsible here? Please get it fixed.

The "highway" does not own
The "highway" does not own property. The state or county has an easement.
Why would snowmobilers get hurt on a haybale? Can't they maintain control of their machine and slow down to avoid the obstacle.
Furthermore, let me poke a hole in your argument. You assert that the property owner does not own the property in the ditch. But then you maintain that if a snowmobiler gets injured in the ditch that the property owner is going to be liable? Which is it? If the property owner is liable, then he must also own the ditch in which the accident occurred, right? If he doesn't own the ditch, it would be the same as suing YOU for a snowmobiler that hits a rock in the ditch in front of MY house. If the property owner doesn't have control over the traffic in the ditch, then he also is not liable if someone gets hurt there. Now, if the snowmobiler should come into his YARD and get hurt, the property owner would be liable, but the snowmobiler would be guilty of trespass.
Plain and simple, if the snowmobiler is riding beyond his ability to control his machine and gets hurt because he fails to avoid and obstacle, then he needs to re-evaluate his riding ability.
Snowmobilers
Okey, I am guessing you do not ride snowmobile by your comments. Yes I can maintain control of my sled just fine, but I should not have to ride 10 miles an hour just to make sure I don't hit anything. Not that it was an issue this year but I have barely missed obstacles people put out before because they get covered by snow or they don't use something visible. White rope is not visible for us, yet I see it used. Haybales can get covered with drifts or snowplow drifts. In that case we don't see it correctly and can hit it wrong. If someone does put something out have brightly colored flags, not everyone is out to enjoy the scenery. Some ride a little harder and at night or in snow which makes these obstacles a hazard.
Haybale liability ???
It might be worth asking a lawyer about the liability that could occur by placeing any object in a public place such as a ditch, in such a way that even unintentionally caused injury to a person.
If that wise guy
blocks or puts an obstruction in the right of way and somone gets hurt he will find out fast that he doesn't have enough money yet.
