Dayton to appeal child care unionization ruling

Posted: December 8, 2011 - 3:50pm

ST. PAUL, Minn. (AP) — Gov. Mark Dayton will contest a court-ordered temporary injunction that sidetracked a planned unionization vote by in-home child care providers.

Dayton's spokeswoman, Katharine Tinucci, announced the Democratic governor's decision Thursday in a brief email message. She says the administration will raise its concerns at a court hearing on the matter scheduled for Jan. 17, 2012.

Tinucci did not immediately provide any further details on Dayton's reasoning. He'd earlier indicated plans to hold off on deciding his next move until after the judge issued a written decision.

Thousands of in-home child care providers were due to receive ballots asking if they wanted to form a union. Opponents argued Dayton exceeded his powers in ordering an election, and a Ramsey County judge issued a restraining order holding off the vote.
