The jury trial scheduled Wednesday in Cass County District Court for the 26-year-old Pillager man, charged with first- and third-degree felony assault of a 22-year-old Pine River man on March 18 in the parking lot of Zorbaz on Gull in Lake Shore, was canceled.
According to the Cass County Attorney Christopher Strandie, Kassulker entered into a plea agreement and pleaded guilty to the third-degree assault charge. The first-degree charge will be dismissed.
The judge set William R. Kassulker’s sentencing hearing for 9 a.m. Dec. 13.
Strandlie said the recommendations to the judge at the time of sentencing will be five years of supervised probation, 30 days of probationary jail time, chemical use assessment, no contact with the victim, restitution and a prohibition from participating in any organized mixed martial arts fights. Final decision on all recommendations is up to the judge at sentencing. This sentence is consistent with the Minnesota Sentencing Guidelines.
According to the criminal complaint filed against Kassulker, Kassulker knocked or pushed the victim to the ground. The victim then got up and swung at Kassulker but missed him completely. Kassulker then punched him in the face with sufficient force to knock him to the ground with one blow. The victim went down and hit his head on the concrete.
