Court charges Brainerd man for possessing child pornography
A 28-year-old Brainerd man in is jail and faces child pornography charges after investigators received tips from the National Center For Missing and Exploited Children.
Dylan David LaPointe made his first appearance Tuesday, Sept. 4, in Crow Wing County District Court in Brainerd where he was charged with five felonies relating to using minors in sexual performance/pornographic work; disseminating pornographic work; possessing pornographic work on a computer or electronic device; and two counts of stalking a victim under age 18 with sexual or aggravated intent.
According to the probable cause court document filed against LaPointe, a Crow Wing County investigator was contacted Thursday by a Minnesota Bureau of Criminal Apprehension agent regarding a possible Cyber Tip from the NCMEC. The Cyber Tipline provides the public and electronic service providers with the ability to report online instances of online enticement of children for sexual acts, child sexual molestation, child pornography, child sex tourism, child sex trafficking, unsolicited obscene materials sent to a child, misleading domain names, and misleading words or digital images on the internet.
The investigator received four tips. The first one was reported July 19 from the public concerning child pornography. The tipster stated LaPointe took inappropriate photos of a 10-year-old girl and was in possession of child pornography. The tipster also alleged LaPointe had access to a 7-year-old girl and there were concerns he may sexually exploit her.
The second tip was received Aug. 29 which claimed LaPointe may have recently been incarcerated for taking sexually explicit photos of a 10-year-old girl and may now have access to a 7-year-old girl.
"The current report appears to regard a reported user (LaPointe) who is claiming to be 28-years-old and a reported recipient who is claiming to be 15-years-old (girl) with whom LaPointe has a significant relationship and/or is in a position of authority," the report stated.
The complaint stated the images were sent from LaPointe's Facebook account and sent to the account of a known 15-year-old girl, who currently lives outside of Minnesota. The images contain inappropriate photos and videos of the girl
A total of 35 files, including 12 videos and 23 images, were sent to LaPointe from the minor female between July and August
The third tip was submitted by Facebook regarding possible child sexual molestation and child pornography. In the chat logs, LaPointe appears to discuss taking sexually explicit images of a child he appears to have access to. Based on the chat logs, it appeared he engaged in sexual activity with the child victim.
Multiple conversations between LaPointe and the identified 15-year-old girl were documented through Facebook chat logs between the dates of July 31 and Aug. 15. Conversations on July 31, Aug. 6, Aug. 8 and Aug. 15 contain sexually explicit content. LaPointe also references a desire to have sexual contact with a 4-year-old girl.
A search warrant was executed Thursday at the residence tied to the online accounts referenced in the four cyber tips. LaPointe admitted to investigators that he had images of the older girl but denied having sexual contact with her. He also denied taking inappropriate photos of the younger girl.
LaPointe has numerous prior convictions for domestic-violence related offenses.
