Pine County sheriff vows to ignore new gun restrictions

PINE CITY, Minn. (AP) — A Minnesota sheriff says he would refuse to enforce any new state or federal regulation that restricts guns.

Pine County Sheriff Robin Cole sent an open letter to residents this week, saying he doesn't believe the federal government has a right to order states to follow mandates that violate the U.S. Constitution.

Cole wrote that he would view any such mandate illegal and refuse to carry it out. He says he believes it is a "moral sin" to erode freedom through administrative rules.

Cole told The Associated Press on Wednesday that he is categorically opposed to any proposal that would infringe on one's constitutional rights. He says he wrote the letter because citizens have been afraid of what the future holds.

He says the issue doesn't apply to just guns.

Wow,

This is an officer that took an oath to uphold the law, protect and serve! I wonder if his mind could be changed if any of his loved ones were taken by a person with mental health problems that just got a gun with a banana clip?

The Constitution violating president

Some people struggle with

Some people struggle with seeing the "unintended consequences" of any executive orders put forth by the President. It is possible that this sheriff is correct as well as the other sheriffs that agree. One would think that they have
contacted legal opinions. Good for him for putting his job on the line.

If one doesn't think the same, then it is easier to make fun of them.

I sure feel better today after all the executive orders. I know the President is looking out for the people.

Will Sheriff Cole's legal defense fund come from Pine

County taxpayers (or maybe the NRA already has a slush-fund to defend their like-minded, peacock-sheriffs). The Duluth News article was more complete than BDD AP story. http://www.duluthnewstribune.com/event/article/id/255814/,

including the comment from a County Board member:
"Pine County Commissioner Doug Carlson said he wasn’t surprised to hear about Cole’s stand, calling the sheriff “opinionated.”

“Here’s a sheriff riding cowboy saying he’s going to do what he’s going to do,” Carlson said.

“Is he going to put us on a county level in a liable position?” Carlson asked, about local law enforcement versus the federal government. “If he can do that, where does that put us as a county board?”

From a local taxpayer's vantage point, I'm happy when my sheriff does his job in a non-political manner, for all constituents, and leaves his Constitutional studies/opinions to "hobby" status. No doubt, Pine County Commisioners are already bracing for quite a few more hours on the job, and looking for ways to minimize the costs sure to come due their local "cowboy". I wonder what law school the sheriff graduated from -- or does he just dabble in Constitutional law like the rest of us? The difference is, when we prattle on like blowhard novices, the County doesn't receive a legal bill.

Sheriff Cole

Thank you Sheriff Cole for upholding your oath to serve and protect which includes protecting our constitutional rights. He and the Sheriff from Kentucky need to run for President and VP. People are not understanding the consequences that Pres. Obama is doing to our country. We need to get at the root of the problem and the problem isn't guns, it's the people that use them. What is causing our young people to flip out and kill masses. Is it drugs, violent video games, depression from the breakdown of the family etc. ??? Maybe take a good hard look at Chicago and then come back and tell me how many more gun laws we need. I hope our own Sheriff has the guts to follow Sheriff Cole and if he does, I will totally support him. Stop being so naive people!

Sheriff Cole

Sheriff Cole was elected by the majority of the voters and is the Senior Law Enforcement Officer of the County. Banning a weapon because of how it looks will not work. Should we also ban certain automobiles/snowmobiles or motor cycles because they look fast and may break the law? Oh wait, it is the people that use them! Ban high capacity magazines? They will just carry more of them if more ammunition is needed. A shotgun is more lethal at close range. Hollow point bullets? The military doesn't even use them due to the damage they do upon expansion when they hit an object. Are they next? Maybe we could ban certain food and non food products that cause serious health problems and death. Some law or rule may get passed which will appease some and anger others and we will move on to the next issue. why not spend as much time, energy and money on the real issues that affect America.

Yesterday,

I went tactical Ice fishing. I deployed my fully automatic assault style ice auger and drilled approximately 18 inches down. I harnessed up my carhartt style BDU's and began to sight in my direct impingement tactical fishing rod. Upon deployment, I found a whole school of terrorist crappies (also known as TC's) of which I apprehended and took back to the barracks for questioning.

I then began using "enhanced" interrogation techniques to get these terrorists to talk. (Otherwise known as water boarding) The "TC's" gave up all their information they had on Usama-bin-Walleye, including whereabouts, alternate hideouts and defensive capabilities . And now today, I shall hunt him down using a predator drone minnow.

The TC's are reading newspaper and are being held in Guantanimo Estomago until their release.

Those of you who disagree with my tactics regarding the apprehension/questioning of said TC's, shall be regarded as "aiding and abetting" a terrorist organization.

Not paid to talk

This guy is not paid by the county to give his opinion, research due process, or set the laws. His job is to enforce the laws that are on the books, period. Lots of people wished they had more power in their job but that’s life. If he doesn’t like it then try and change it....but not during work hours!!

Oh my!

So, he feels any nut job ought to have access to a gun because that is part of what is being considered. Not just the selling of military-style weapons and large-capacity ammunition feeding devices capable of accepting more than 10 rounds. He really ought to find out exactly what is being put in the legislation first before he makes a fool of himself.

a patriot

It is refreshing to see a public official stand up for the law and not just blindly follow a president with a clear agenda of restricting the rights of the people.
This country was founded by patriots, people that saw the damage that a dictator-like, monarchy could cause. These people knew that government left unchecked by the people would always be corrupt.

The Supreme Court will hear arguments, if someone thinks legislation or executive powers are unconstitutional.

I can't believe

how many posters are turning this into an argument about gun control. This article, this issue is about ONLY an elected sheriff proclaiming he will break the law, not enforce the law, if it is enacted. This issue is no different than if he said "I don't believe the government should mandate how fast I drive my car or how many deer I can shoot, or how many fish I can take home. I won't enforce those laws." This is about a sheriff admitting that he intends to not uphold the law for the county, state and country he is sworn to defend, which I bet he had to swear on a bible to those words.

The people who suffered and bled for the freedoms that we all enjoy, built multiple safeguards into our constitution. The first safeguard, was three distinct, separate branches of government, The judicial, for interpreting laws, the executive for a last failsafe, and the legislative to create laws. The second was a democracy, these people would have to be voted in by the will of the people.
The last failsafe was that the people should always have a way should all else fail to keep the government honest, that the people should have the power to keep and bear arms. Not for hunting, not for target shooting, not for sport. The people should have the right to keep and bear arms for only one reason, for a well regulated militia, both as a last resort for attackers and to always ensure that should the government ever overpower the people that they have that one last resort. Read, "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."
That doesn't say, shall be allowed so that they can hunt, or so long as they don't have more than ten rounds of ammo shall not be infringed. It says "shall not be infringed".
Now we have a president, that has told us that we are required to purchase healthcare or we shall be considered a criminal, who has said, legislative branch be damned, I can use executive privilege to limit arms. Who has used the victims of a horrible tragedy, to further a personal political agenda.
With a president like this, I for one, am grateful for patriots like sheriff Cole, who still remember what our country was founded on, what our forefathers fought to protect and who still know the law.

Actually, he is doing exactly that. He says he will circumvent due process of the law, if it is enacted by law. He IS creating his own law, saying he won't enforce the law of the country.

And any of you other idiots who think it is patriotic to ignore laws, so what you are promoting is anarchy? I thought you idiots have been preaching "law and order" since Reagan was elected. I guess that only means the laws that you, in your low-IQ minds, think are worth following. Hypocrites.

The law at its core is the constitution. If Obama wants to propose legislation to revoke the 2nd amendment and he gets it passed. Then I as a LAW abiding citizen will follow it.
Being an idiot, I admit that the words "the right to keep and bear arms" are hard to sound out, but I think I get their meaning. It seems as though the constitution says that I have the right to keep and bear arms.
Cole has said he will uphold the law, which for now says we have the right to keep and bear arms. Also, the federal Government cannot circumvent state rights, which cole also knows. The people, the states and then the federal Government control the laws, not the President, congress, maybe the states and if he has time the people.
