Judge dismisses challenge to synthetic drug law

Posted: November 16, 2011 - 9:15am

MINNEAPOLIS (AP) — A Hennepin County judge has dismissed a challenge to Minnesota's law banning sales of synthetic drugs.

A lawsuit filed by a Duluth retailer, Last Place on Earth, and two other parties, said the law passed by the state Legislature this year is too vague and could not be understood by anyone without a biology degree.

In a ruling this week, Judge William Howard said the law could be understood by "persons of ordinary intelligence." The Duluth News Tribune reports the judge also said the plaintiffs couldn't challenge the law because they haven't been prosecuted for breaking it.

The law prohibits the sale of so-called analogs — substances that are similar in chemical makeup to banned compounds used to manufacture synthetic marijuana.
